Introduction

Welcome to TEXTuned, a software-as-a-service (“SaaS”) platform developed and operated by DashWord FZ LLC (“DashWord”, “we”, “our”, or “us”).

These Terms & Conditions (“Terms”) constitute a legally binding agreement between DashWord FZ LLC and any individual or legal entity (“Customer”, “you”, or “your”) accessing or using TEXTuned.

TEXTuned provides AI-powered translation, localization, multilingual SEO optimization, and related cloud-based language technologies designed to help businesses manage multilingual digital content across supported platforms.

Please read these Terms carefully before accessing or using TEXTuned.

By creating an account, installing the TEXTuned plugin, connecting a website, purchasing a subscription or prepaid credits, accessing our APIs, or otherwise using any part of the TEXTuned platform, you acknowledge that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy, Cancellation & Refund Policy, and any additional policies or agreements expressly incorporated by reference.

If you do not agree to these Terms, you must not access or use TEXTuned.

1.About DashWord FZ LLC

TEXTuned is a commercial software product owned, developed, and operated by DashWord FZ LLC.

Throughout these Terms:

  • DashWord“, “we“, “our“, or “us” refers to DashWord FZ LLC.
  • TEXTuned” refers collectively to the TEXTuned platform, WordPress plugin, cloud platform, APIs, customer portal, websites, backend services, documentation, and any related services operated by DashWord FZ LLC.

DashWord develops TEXTuned as a cloud-based multilingual platform enabling customers to:

  • Translate digital content into multiple languages;
  • Generate AI-assisted multilingual SEO content;
  • Manage localization workflows;
  • Purchase subscriptions and prepaid translation credits;
  • Manage multilingual websites;
  • Access cloud-based APIs and language services;
  • Receive technical support; and
  • Utilize additional services introduced as part of the TEXTuned platform.

DashWord may introduce new products, integrations, or functionality from time to time. Unless otherwise stated, such services will also be governed by these Terms.

2.Acceptance of these Terms

These Terms become effective immediately upon the earliest occurrence of any of the following:

  • Creating a TEXTuned account;
  • Installing or activating the TEXTuned plugin;
  • Connecting a website or supported platform to TEXTuned;
  • Accessing or using any TEXTuned cloud service or API;
  • Purchasing a subscription, Top-Up credits, Pay-As-You-Go (PAYG) credits, or any paid service;
  • Using any AI-powered feature provided by TEXTuned; or
  • Otherwise accessing or using any part of the TEXTuned platform.

If you are entering into these Terms on behalf of a company, organization, or other legal entity, you represent and warrant that you have the authority to bind that entity to these Terms.

If you do not have such authority, or if you do not agree to these Terms, you must not use TEXTuned.

3.Eligibility

To use TEXTuned, you must:

  • Be at least eighteen (18) years of age, or the age of majority in your jurisdiction;
  • Have the legal capacity to enter into binding agreements;
  • Provide accurate and complete registration information;
  • Comply with all applicable laws and regulations; and
  • Not be prohibited from using our services under applicable law.

DashWord reserves the right to refuse service, suspend access, or terminate accounts where these eligibility requirements are not satisfied.

4.Definitions

For the purposes of these Terms, the following definitions apply:

Account means a registered TEXTuned customer account used to access the Services.

AI Services means artificial intelligence technologies made available through TEXTuned, including translation assistance, multilingual SEO generation, terminology extraction, language analysis, and related capabilities.

Customer means any individual or legal entity using or subscribing to TEXTuned.

Customer Content means any content submitted, uploaded, synchronized, generated, or otherwise processed through TEXTuned, including website content, product information, metadata, translations, prompts, terminology, and related materials.

Plugin means the official TEXTuned WordPress plugin and any official extensions or future plugins developed by DashWord.

Services means all software, cloud services, APIs, websites, plugins, portals, documentation, AI features, support services, and related offerings provided under the TEXTuned brand.

Subscription means a recurring commercial agreement granting access to specific TEXTuned features, quotas, or services during an applicable billing period.

Tenant means a customer account, organization, business, website, or workspace registered within the TEXTuned platform.

Top-Up Credits means prepaid translation or service credits purchased independently of recurring subscriptions.

Wallet means the customer’s stored balance of prepaid Top-Up or Pay-As-You-Go (PAYG) credits.

Translation Units means the measurable units used by TEXTuned to calculate translation and related service consumption, as determined by DashWord from time to time.

5.Customer Accounts

Access to certain TEXTuned features requires a registered customer account.

Customers agree to:

  • Provide accurate, complete, and current registration information;
  • Maintain the confidentiality of their account credentials;
  • Promptly update account information when changes occur;
  • Notify DashWord immediately of any unauthorized access or suspected security incident; and
  • Accept responsibility for all activities conducted through their account unless caused by DashWord’s negligence or breach of these Terms.

Customers may not:

  • Share accounts with unauthorized individuals;
  • Sell, lease, sublicense, or transfer accounts without DashWord’s written authorization;
  • Create accounts using false identities or misleading information; or
  • Attempt to circumvent account restrictions or security controls.

DashWord reserves the right to suspend or terminate accounts that violate these Terms or that present a security, legal, or operational risk.

6.Tenant and Workspace

TEXTuned is designed around a tenant-based architecture.

Each Tenant represents a customer organization, business, website, or other workspace connected to the TEXTuned platform.

Subscriptions, quotas, wallets, translation history, billing records, supported languages, AI features, integrations, and other service entitlements are associated with the relevant Tenant.

Customers are responsible for ensuring that only authorized users are granted access to their Tenant.

Where multiple users are permitted within a Tenant, the Customer remains responsible for managing permissions and ensuring compliance with these Terms.

DashWord may establish reasonable technical limits relating to Tenants, connected websites, users, projects, or other platform resources based on the applicable subscription plan.

7.Description of the Services

TEXTuned is a cloud-based Software-as-a-Service (SaaS) platform that provides multilingual translation, localization, artificial intelligence (“AI”) assisted language services, multilingual search engine optimization (“SEO”), and related technologies for supported digital platforms.

The Services currently include, but are not limited to:

  • Automated website translation;
  • AI-assisted translation optimization;
  • Multilingual SEO generation and optimization;
  • Translation project management;
  • Translation memory and terminology management;
  • Language detection and localization services;
  • Translation job orchestration;
  • Cloud-based APIs;
  • Subscription and wallet management;
  • AI-powered content enhancement;
  • Customer administration tools;
  • Technical support; and
  • Additional services introduced by DashWord from time to time.

TEXTuned continuously evolves. DashWord may modify, improve, replace, add, or discontinue features where reasonably necessary to improve the platform, maintain security, comply with applicable law, or introduce new functionality.

Unless otherwise stated, new features introduced as part of TEXTuned shall be governed by these Terms.

8.Supported Platforms

TEXTuned is designed to integrate with supported content management systems, e-commerce platforms, websites, applications, and other digital platforms.

At the time of these Terms, supported platforms primarily include WordPress and WooCommerce. DashWord may introduce support for additional platforms, connectors, APIs, SDKs, applications, or integrations in the future.

Support for a specific platform does not guarantee compatibility with every version, configuration, third-party plugin, customization, hosting environment, or software ecosystem.

Customers remain responsible for ensuring that their own environments meet the published technical requirements for TEXTuned.

DashWord may discontinue support for legacy platforms or versions where continued support becomes technically impractical, commercially unreasonable, or creates security risks.

9.Artificial Intelligence Features

TEXTuned incorporates artificial intelligence technologies to assist customers in generating, improving, translating, localizing, and optimizing multilingual content.

Depending on the subscription plan and enabled features, AI capabilities may include:

  • Translation enhancement;
  • Multilingual SEO generation;
  • Metadata optimization;
  • Terminology extraction;
  • Keyword generation;
  • Language analysis;
  • Content optimization;
  • Context-aware localization;
  • AI-assisted writing; and
  • Other language-related capabilities introduced by DashWord.

AI-generated outputs are intended to assist customers and should not be considered guaranteed to be accurate, complete, legally compliant, or suitable for every use case.

Customers remain responsible for reviewing, validating, editing, and approving AI-generated content before publishing or relying upon it.

DashWord does not warrant that AI-generated outputs will always be factually accurate, free from bias, legally compliant, or appropriate for any particular purpose.

10.Translation Services

TEXTuned provides machine-assisted and AI-assisted translation technologies designed to facilitate multilingual content management.

Translation quality may vary depending on factors including:

  • Source language;
  • Target language;
  • Industry terminology;
  • Content complexity;
  • Customer-provided terminology;
  • Customer glossaries;
  • SEO requirements;
  • AI capabilities; and
  • Third-party translation technologies utilized by the platform.

TEXTuned is designed to improve translation quality through technology; however, translations generated by the platform may require human review before publication.

Customers remain solely responsible for reviewing translated content before making it publicly available.

DashWord does not guarantee that translated content will be free of linguistic, grammatical, contextual, cultural, legal, or factual inaccuracies.

11.Multilingual SEO Features

TEXTuned includes AI-assisted multilingual SEO capabilities intended to help customers improve the discoverability of multilingual websites.

Depending on the subscription plan and enabled features, these services may include:

  • SEO title generation;
  • Meta description generation;
  • Keyword suggestions;
  • URL slug localization;
  • Image alternative text generation;
  • Structured multilingual metadata;
  • Language-specific optimization recommendations; and
  • Other multilingual SEO features introduced by DashWord.

SEO recommendations generated by TEXTuned are intended as decision-support tools.

DashWord does not guarantee:

  • Search engine rankings;
  • Organic traffic increases;
  • Search engine indexing;
  • Keyword positions;
  • Commercial performance; or
  • Business outcomes resulting from use of the platform.

Search engine algorithms are controlled by third parties and remain outside the control of DashWord.

12.Beta Features and Early Access

From time to time, DashWord may provide customers with access to beta features, preview releases, experimental functionality, or early-access services.

Such features may:

  • Be incomplete;
  • Change without notice;
  • Be modified or discontinued at any time;
  • Produce unexpected results;
  • Contain defects or errors; or
  • Be subject to additional usage limitations.

Unless expressly stated otherwise, beta features are provided on an “as available” basis without additional warranties.

Customers choose to use beta functionality at their own discretion.

DashWord welcomes customer feedback regarding beta features and may use such feedback to improve the platform without creating any obligation to implement requested changes.

13.Future Integrations and Third-Party Services

TEXTuned may integrate with third-party products, cloud services, APIs, content management systems, AI providers, payment providers, CRM systems, analytics platforms, and other technologies.

Such integrations are provided to enhance the functionality of the platform.

DashWord may introduce, modify, replace, or discontinue integrations where reasonably necessary for technical, commercial, operational, security, or legal reasons.

Third-party services remain governed by their respective terms and privacy policies.

DashWord is not responsible for the availability, functionality, security, or policies of third-party services that are outside our control.

Where TEXTuned interacts with third-party providers on behalf of customers, DashWord acts solely as a technology intermediary unless expressly stated otherwise.

14.Service Availability and Maintenance

DashWord uses commercially reasonable efforts to make TEXTuned available on a reliable and secure basis.

However, customers acknowledge that uninterrupted availability cannot be guaranteed.

The Services may be temporarily unavailable due to:

  • Scheduled maintenance;
  • Emergency maintenance;
  • Infrastructure upgrades;
  • Security updates;
  • Third-party service interruptions;
  • Internet connectivity issues;
  • Force majeure events; or
  • Other circumstances beyond DashWord’s reasonable control.

Where reasonably practicable, DashWord will endeavor to provide advance notice of scheduled maintenance that may materially affect service availability.

DashWord reserves the right to suspend or limit access where necessary to:

  • Protect the security or integrity of the platform;
  • Prevent abuse or fraudulent activity;
  • Perform maintenance;
  • Comply with legal obligations; or
  • Protect customers or third parties.

15.Customer Support

DashWord provides customer support to assist customers in using TEXTuned and resolving technical issues.

Support channels, response times, and available services may vary depending on:

  • Subscription plan;
  • Service level;
  • Support request type;
  • Business hours;
  • Operational workload; and
  • Other reasonable operational considerations.

Customer support may include:

  • Technical assistance;
  • Billing support;
  • Account-related inquiries;
  • Product guidance;
  • Documentation;
  • Knowledge base resources;
  • Email communications;
  • CRM-assisted customer service; and
  • Other support services made available by DashWord.

While DashWord strives to resolve support requests promptly, we do not guarantee specific response or resolution times unless expressly agreed in a separate written service agreement.

Customers are expected to provide sufficient information to enable DashWord to investigate reported issues efficiently.

16.Subscription Plans

TEXTuned offers subscription-based access to its Services through one or more commercial plans published by DashWord FZ LLC from time to time.

Each subscription plan may include different combinations of:

  • Translation Units;
  • AI-assisted features;
  • Multilingual SEO capabilities;
  • Supported languages;
  • Connected websites or projects;
  • API access;
  • Storage allocations;
  • Customer support levels;
  • Integration capabilities; and
  • Other features determined by DashWord.

Current subscription plans, pricing, quotas, and included features are published on the official TEXTuned website and may be updated from time to time.

Unless expressly stated otherwise, subscription features and limits apply only during the applicable billing period.

17.Free Plans, Trials and Promotional Offers

DashWord may, at its sole discretion, offer:

  • Free plans;
  • Trial periods;
  • Promotional access;
  • Complimentary Translation Units;
  • Partner programs;
  • Beta access;
  • Educational programs; or
  • Other promotional offers.

Such offers may be limited by:

  • Time;
  • Features;
  • Usage;
  • Geography;
  • Customer eligibility; or
  • Other conditions determined by DashWord.

DashWord reserves the right to modify, suspend, or discontinue promotional offers at any time unless otherwise required by applicable law.

Unless expressly stated otherwise, promotional benefits may not be redeemed for cash or transferred to another customer.

18.Wallets, Top-Up Credits and Pay-As-You-Go (PAYG)

TEXTuned provides customers with the ability to purchase prepaid Translation Units independently of recurring subscriptions.

These prepaid units may be offered as:

  • Top-Up Credits;
  • Pay-As-You-Go (PAYG) Credits; or
  • Other prepaid credit mechanisms introduced by DashWord.

Prepaid credits are stored within the Customer’s Wallet and remain associated with the relevant Tenant.

Unless otherwise stated:

  • Wallet balances belong exclusively to the associated Tenant;
  • Wallet balances are non-transferable;
  • Wallet balances may not be exchanged for cash;
  • Wallet balances may not be sold or assigned to another customer; and
  • Wallet balances remain available until consumed or otherwise adjusted in accordance with these Terms.

Where multiple sources of Translation Units exist, TEXTuned may determine the order in which available units are consumed based on the operational rules of the platform.

19.Billing and Payments

Customers purchasing paid Services agree to pay all applicable fees associated with their selected subscription plans, Wallet purchases, Top-Up Credits, PAYG Credits, or other commercial offerings.

Payments are processed through authorized third-party payment providers selected by DashWord.

DashWord does not process or store complete payment card details.

Customers authorize DashWord and its authorized payment processor to:

  • Process payments;
  • Renew subscriptions where applicable;
  • Apply authorized recurring charges;
  • Issue invoices;
  • Process refunds where applicable; and
  • Maintain billing records necessary to administer customer accounts.

Customers are responsible for ensuring that payment information remains accurate and valid.

DashWord reserves the right to suspend paid Services where payment cannot be successfully processed.

20.Subscription Renewals

Unless cancelled in accordance with these Terms, recurring subscriptions automatically renew at the end of each billing cycle using the customer’s previously authorized payment method.

By subscribing to TEXTuned, the Customer authorizes recurring charges for the selected subscription until cancelled.

Subscription renewals are processed using secure payment methods supported by DashWord’s authorized payment processor.

Customers may update their payment method at any time through the mechanisms provided by DashWord or its authorized payment provider.

Where a Customer authorizes a new payment method, future recurring renewals will use the most recently authorized payment method.

21.Plan Upgrades and Downgrades

Customers may change their subscription plan subject to the options made available by DashWord.

Unless otherwise specified:

Upgrades

Subscription upgrades become effective immediately upon successful processing.

Applicable features, quotas, and entitlements become available according to the upgraded plan.

Additional charges may apply depending on the selected upgrade.

Downgrades

Downgrades become effective at the beginning of the next billing cycle.

Customers retain access to the features and entitlements of their existing subscription until the current billing period expires.

DashWord reserves the right to define additional operational rules governing plan transitions where reasonably necessary.

22.Cancellation of Subscriptions

Customers may cancel recurring subscriptions at any time.

Unless otherwise required by applicable law or expressly agreed by DashWord:

  • Cancellation becomes effective at the end of the current paid billing period;
  • The current subscription remains active until that billing period expires;
  • Future recurring renewal charges are discontinued following the effective cancellation date; and
  • Access to subscription-based features will end upon expiration of the applicable billing period.

Subscription cancellation does not automatically delete customer accounts, Customer Content, or Wallet balances.

Additional details regarding cancellations and refunds are provided in the TEXTuned Cancellation & Refund Policy, which forms part of these Terms.

23.Failed Payments and Grace Period

If a recurring subscription renewal cannot be successfully processed, DashWord may initiate a payment recovery process.

Subject to the operational rules of the platform:

  • Customers may be granted a temporary Grace Period;
  • DashWord may perform additional renewal attempts;
  • Customers may be notified regarding failed payment attempts;
  • Services may continue during the applicable Grace Period; and
  • Subscription status may be updated according to the outcome of the renewal process.

Where payment cannot be successfully recovered within the applicable recovery period, DashWord may suspend subscription-based Services until payment issues have been resolved.

The operational details of renewal retries and Grace Periods may be updated from time to time to improve service reliability and payment recovery.

24.Taxes

Unless expressly stated otherwise, published prices exclude any applicable taxes, duties, levies, or governmental charges.

Customers are responsible for paying any applicable taxes associated with their purchases, except where DashWord is legally required to collect and remit such taxes.

Where applicable, DashWord may include taxes, value-added tax (VAT), goods and services tax (GST), sales tax, or similar charges on invoices in accordance with applicable law.

25.Pricing Changes

DashWord may revise subscription pricing, Wallet pricing, Top-Up pricing, PAYG pricing, or other commercial charges from time to time.

Pricing changes shall not affect completed purchases.

For recurring subscriptions, revised pricing may apply upon the next renewal cycle following reasonable notice where required by applicable law.

DashWord will make commercially reasonable efforts to notify customers of material pricing changes before they become effective.

26.Refunds

Refunds are governed by the separate TEXTuned Cancellation & Refund Policy, which forms an integral part of these Terms.

Unless expressly required by applicable law or approved by DashWord in writing:

  • Subscription fees are non-refundable;
  • Partial subscription periods are not refunded;
  • Top-Up Credits and PAYG Credits are non-refundable once purchased;
  • Unused Wallet balances are not redeemable for cash; and
  • Promotional credits have no cash value.

Nothing in these Terms limits any mandatory consumer rights that cannot legally be excluded.

27.Customer Responsibilities

Customers are responsible for using TEXTuned in a lawful, responsible, and ethical manner.

By using the Services, Customers agree to:

  • Provide accurate and current account information;
  • Maintain the confidentiality of their account credentials;
  • Ensure that only authorized users access their Tenant;
  • Maintain appropriate security for their own websites, hosting environments, and user accounts;
  • Review all AI-generated and translated content before publication;
  • Comply with all applicable laws and regulations;
  • Respect the intellectual property rights and privacy rights of others;
  • Promptly report suspected security incidents or unauthorized account access; and
  • Cooperate with DashWord where reasonably necessary to investigate security, fraud, or abuse incidents.

Customers remain solely responsible for all activities conducted through their accounts unless such activities result directly from DashWord’s negligence or breach of these Terms.

28.Acceptable Use Policy

Customers shall not use TEXTuned to:

  • Violate any applicable law or regulation;
  • Process unlawful, defamatory, fraudulent, deceptive, or abusive content;
  • Infringe intellectual property rights or other proprietary rights;
  • Upload malware, ransomware, spyware, malicious code, or other harmful software;
  • Attempt unauthorized access to any systems, accounts, or networks;
  • Circumvent quotas, usage limitations, licensing restrictions, or technical controls;
  • Reverse engineer, decompile, disassemble, or attempt to derive the source code of TEXTuned except where expressly permitted by applicable law;
  • Perform automated attacks, vulnerability scanning, or penetration testing without prior written authorization from DashWord;
  • Interfere with or disrupt the operation of the Services;
  • Use TEXTuned to generate spam, phishing content, or other malicious communications;
  • Misrepresent AI-generated content as independently verified factual information where doing so would be misleading or unlawful; or
  • Use the Services in any manner that may reasonably compromise the security, integrity, availability, or reputation of TEXTuned or its customers.

DashWord reserves the right to investigate suspected violations of this Acceptable Use Policy and to take appropriate action, including suspension or termination of access where necessary.

29.Artificial Intelligence Disclaimer

TEXTuned incorporates artificial intelligence technologies to assist Customers in producing multilingual content and language-related outputs.

Customers acknowledge and agree that:

  • AI-generated outputs are probabilistic in nature and may contain errors, omissions, inaccuracies, or unintended results;
  • AI-generated translations, SEO recommendations, terminology, summaries, or other outputs should be reviewed before publication or reliance;
  • AI-generated content does not constitute legal, financial, medical, regulatory, or professional advice;
  • DashWord does not guarantee the factual accuracy, completeness, or suitability of AI-generated outputs for any specific purpose; and
  • Customers remain solely responsible for verifying all outputs prior to publication, commercial use, or distribution.

DashWord continuously improves AI-assisted features but cannot guarantee that generated outputs will always meet Customer expectations or business objectives.

30.Customer Content

Customers retain all ownership rights in their Customer Content.

Nothing in these Terms transfers ownership of Customer Content to DashWord.

By submitting Customer Content to TEXTuned, Customers grant DashWord a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, process, reproduce, and otherwise use Customer Content solely to:

  • Provide the Services;
  • Perform translations and localization;
  • Generate multilingual SEO content;
  • Synchronize content across supported platforms;
  • Deliver AI-assisted features requested by the Customer;
  • Maintain platform functionality;
  • Troubleshoot technical issues;
  • Protect the security of the Services; and
  • Comply with applicable legal obligations.

This license automatically terminates when Customer Content is permanently removed from TEXTuned, subject to applicable legal retention obligations and backup processes.

Customers represent and warrant that they possess all rights necessary to submit Customer Content for processing through TEXTuned.

31.Intellectual Property

TEXTuned, including its software, source code, object code, APIs, documentation, user interface, branding, trademarks, logos, graphics, workflows, databases, AI models developed by DashWord, and all related intellectual property rights, remain the exclusive property of DashWord FZ LLC and its licensors.

Except as expressly permitted by these Terms, Customers shall not:

  • Copy, reproduce, distribute, modify, or create derivative works of TEXTuned;
  • Sell, sublicense, lease, rent, or commercially exploit the Services;
  • Remove proprietary notices or trademarks;
  • Use DashWord trademarks without prior written permission; or
  • Attempt to gain unauthorized access to proprietary technologies.

Nothing in these Terms grants Customers ownership of any intellectual property belonging to DashWord other than the limited rights necessary to use the Services during an active subscription or other authorized access period.

32.Third-Party Services

TEXTuned may integrate with or rely upon third-party products, cloud infrastructure providers, artificial intelligence providers, payment processors, customer relationship management platforms, analytics services, content management systems, and other external technologies.

Customers acknowledge that:

  • Certain functionality depends upon third-party services beyond DashWord’s direct control;
  • Third-party providers maintain their own terms, privacy policies, and service commitments;
  • Changes made by third-party providers may affect certain TEXTuned features; and
  • DashWord is not responsible for interruptions or failures caused solely by third-party services.

DashWord will use commercially reasonable efforts to minimize the impact of third-party service interruptions where practicable.

33.Confidentiality

Each party agrees to treat confidential information received from the other party as confidential and to use such information solely for purposes related to the performance of these Terms.

Confidential information includes, where applicable:

  • Business information;
  • Technical information;
  • Security information;
  • Pricing not publicly disclosed;
  • Product roadmaps;
  • Customer data;
  • Credentials;
  • API keys;
  • Proprietary methodologies; and
  • Other information reasonably understood to be confidential.

Confidentiality obligations shall not apply to information that:

  • Is publicly available without breach of these Terms;
  • Was lawfully known prior to disclosure;
  • Is independently developed without reference to confidential information; or
  • Must be disclosed pursuant to applicable law or court order.

These confidentiality obligations survive termination of these Terms.

34.Data Protection

DashWord processes personal information in accordance with the TEXTuned Privacy Policy.

Where DashWord processes Customer Content on behalf of Customers, DashWord generally acts as a Data Processor while the Customer remains the Data Controller.

Customers are responsible for ensuring that their use of TEXTuned complies with applicable data protection laws.

Nothing in these Terms limits or replaces any rights or obligations established by the Privacy Policy or any applicable Data Processing Agreement between the parties.

35.Suspension and Termination

DashWord may suspend or terminate access to TEXTuned immediately where reasonably necessary, including where:

  • Customers materially breach these Terms;
  • Payment obligations remain unresolved;
  • Continued access creates security risks;
  • Fraudulent or unlawful activity is suspected;
  • Required by applicable law;
  • Necessary to protect DashWord, other customers, or third parties; or
  • Customers repeatedly violate acceptable use requirements.

Where reasonably practicable, DashWord will provide notice before suspension.

Suspension does not relieve Customers of outstanding payment obligations incurred prior to suspension.

Customers may terminate their use of TEXTuned at any time, subject to any applicable subscription commitments and the Cancellation & Refund Policy.

Termination of these Terms does not affect accrued rights, payment obligations, intellectual property rights, confidentiality obligations, or any provisions intended to survive termination.

36.Export of Customer Data

Where supported by the Services, Customers may export their Customer Content or other available account information using the tools provided by DashWord.

Customers are encouraged to maintain independent backups of important information.

DashWord does not guarantee indefinite retention of Customer Content following account termination or deletion beyond applicable legal or operational retention requirements.

Customers remain responsible for exporting any information they wish to retain before requesting permanent account deletion.

37.Disclaimer of Warranties

TEXTuned is provided on an “as is” and “as available” basis to the maximum extent permitted by applicable law.

While DashWord FZ LLC uses commercially reasonable efforts to provide reliable, secure, and high-quality Services, we do not warrant or guarantee that:

  • The Services will be uninterrupted, error-free, or continuously available;
  • Every defect or error can or will be corrected;
  • The Services will meet every Customer’s individual requirements;
  • AI-generated outputs, translations, or SEO recommendations will always be accurate, complete, or suitable for a particular purpose;
  • Third-party integrations or services will remain continuously available; or
  • The Services will operate without interruptions caused by factors outside DashWord’s reasonable control.

Except as expressly stated in these Terms, all warranties, representations, and conditions, whether express, implied, statutory, or otherwise, are hereby disclaimed to the fullest extent permitted by applicable law.

Nothing in these Terms excludes any warranty or right that cannot legally be excluded under applicable law.

38.Limitation of Liability

To the maximum extent permitted by applicable law, DashWord FZ LLC, its directors, officers, employees, affiliates, licensors, and service providers shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of TEXTuned.

This includes, without limitation:

  • Loss of profits;
  • Loss of revenue;
  • Loss of business opportunities;
  • Loss of goodwill;
  • Loss of anticipated savings;
  • Loss or corruption of data;
  • Business interruption;
  • Website downtime;
  • Search engine ranking fluctuations;
  • AI-generated inaccuracies;
  • Translation inaccuracies;
  • Third-party service failures; or
  • Any other indirect or consequential loss.

To the maximum extent permitted by law, DashWord’s aggregate liability arising from or relating to these Terms shall not exceed the total amount actually paid by the Customer to DashWord for the Services during the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law, including liability for fraud, fraudulent misrepresentation, gross negligence, or willful misconduct where applicable.

39.Indemnification

The Customer agrees to defend, indemnify, and hold harmless DashWord FZ LLC, its affiliates, directors, officers, employees, contractors, licensors, and service providers from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or relating to:

  • The Customer’s breach of these Terms;
  • Customer Content;
  • Violation of applicable laws or regulations;
  • Infringement of intellectual property rights or privacy rights of third parties;
  • Misuse of the Services;
  • Unauthorized use of the Customer’s account; or
  • Any negligent or unlawful acts or omissions by the Customer.

DashWord reserves the right to assume exclusive control of the defense of any matter subject to indemnification, at the Customer’s expense, where permitted by applicable law.

40.Force Majeure

DashWord shall not be liable for any delay, interruption, or failure to perform its obligations under these Terms where such delay or failure results from circumstances beyond its reasonable control.

Such circumstances may include, without limitation:

  • Natural disasters;
  • Fire;
  • Flood;
  • Earthquakes;
  • Epidemics or pandemics;
  • War;
  • Terrorism;
  • Civil unrest;
  • Government actions;
  • Labor disputes;
  • Internet outages;
  • Cloud infrastructure failures;
  • Utility failures;
  • Cybersecurity incidents affecting third-party infrastructure; or
  • Other events beyond DashWord’s reasonable control.

DashWord will use commercially reasonable efforts to minimize the impact of such events whenever practicable.

41.Assignment

Customers may not assign, transfer, sublicense, or otherwise transfer any rights or obligations under these Terms without the prior written consent of DashWord.

DashWord may assign or transfer these Terms, in whole or in part, as part of:

  • A merger;
  • Acquisition;
  • Corporate restructuring;
  • Sale of assets;
  • Internal reorganization; or
  • Other legitimate business transaction.

Any permitted assignment shall remain subject to these Terms.

42.Severability

If any provision of these Terms is determined by a court or competent authority to be invalid, unlawful, or unenforceable, the remaining provisions shall continue in full force and effect.

Any invalid provision shall, where possible, be interpreted or modified only to the extent necessary to make it enforceable while preserving its original intent.

43.No Waiver

Failure by DashWord to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Any waiver shall be effective only if made expressly in writing by an authorized representative of DashWord.

A waiver of any breach shall not constitute a waiver of any subsequent breach.

44.Entire Agreement

These Terms, together with the Privacy Policy, Cancellation & Refund Policy, and any additional agreements expressly incorporated by reference, constitute the entire agreement between DashWord and the Customer regarding the use of TEXTuned.

These documents supersede all prior discussions, proposals, understandings, representations, or agreements relating to the Services.

In the event of any conflict between these Terms and another published policy, these Terms shall prevail unless the other document expressly states otherwise.

45.Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates, without regard to its conflict of law principles.

The parties agree to use reasonable efforts to resolve any dispute through good-faith discussions before initiating formal legal proceedings.

Unless otherwise required by applicable law, the courts having jurisdiction over DashWord FZ LLC’s registered place of business shall have exclusive jurisdiction over disputes arising out of or relating to these Terms.

Nothing in this section limits either party’s right to seek urgent injunctive or equitable relief where appropriate.

46.Changes to these Terms

DashWord FZ LLC may update these Terms from time to time to reflect:

  • Changes to the Services;
  • New product features;
  • Security improvements;
  • Changes in applicable law;
  • Regulatory requirements;
  • Business operations; or
  • Other legitimate commercial reasons.

When material changes are made, DashWord will update the Last Updated date at the beginning of these Terms.

Where required by applicable law, we may also provide additional notice through the TEXTuned platform, our website, email communications, or other appropriate channels.

Continued use of TEXTuned after revised Terms become effective constitutes acceptance of the updated Terms to the extent permitted by applicable law.
